Panel maker files lawsuits over Nokia, Huawei phones

A TPK executive said the company's subsidiary in Xiamen China is suing Nokia, its contract manufacturer and distributor in China over alleged infringement on its one-glass solution (OGS) patent for touch screens, which is now a common feature for many mobile devices, including smartphones.

TPK's subsidiary is also suing Huawei's touch panel supplier and its mobile phone distributor in China for also allegedly infringing on its OGS patent.

The two phones involved in the legal fights are the Nokia 610 and Huawei C8812E, according to the TPK executive, Chung Chi-li.

TPK is seeking damages of 26.91 million yuan (US$4.32 million) and 66 million yuan respectively from the Nokia and Huawei in the cases that it has taken to the Xiamen Intermediate People's Court, Chung said.

He said this is the first time that the company has ever filed a patent infringement lawsuit. It said it hopes the lawsuit can let customers know more about touch panel patents.

Asked if it would too difficult to win a patent lawsuit in China, Chung said TPK is well prepared and confident.

Although the touch patent is at the center of the dispute, Chung said it has been difficult to identify the touch panel supplier and therefore TPK has named the mobile phones' manufacturers and distributors as defendants.

TPK has a patent portfolio of about 400 items and its touch panel patents are valid in China, Taiwan, Japan, the United States and Europe, the executive said.

He said amounts of damages in the two cases are calculated according to the phones' sales volumes in China.
