Waugh suffered a serious gash to the head in the 65th minute incident but, after viewing video footage, Squire said their was reason to believe the boot of another player, not So'oialo, might have been responsible for that injury. Squire said the contact So'oialo made with Waugh was clearly not intentional but demonstrated an unacceptable degree of carelessness and risk of injury. In fixing a penalty, Squire said he took into account So'oialo's "largely unblemished record and his reputation and stature as a senior rugby player.''
