Lawmakers urged to resolve detainee rights

WASHINGTON -- The top U.S. law enforcement official on Monday called on Congress to draft rules for court hearings for terror suspects in the wake of a landmark Supreme Court ruling that they have the right to challenge their detention.

Attorney General Michael Mukasey said lawmakers — and not judges — should resolve the legal questions left open by the Supreme Court’s June 16 decision.

“Judges play an important role in deciding whether a chosen policy is consistent with our laws and the constitution,” Mukasey said in a speechs in Washington. “But it is our elected leaders who have the responsibility for making policy choices in the first instance.”
