HK activists protest against Scarborough Shoal standoff

HONG KONG -- A group of Hong Kong activists protested outside the Philippine consulate office Thursday against a standoff near the Scarborough Shoal in the South China Sea, reiterating China's sovereignty claim over the reef since the 1200s in a monthlong territorial row with the Philippines.

In an open letter to Philippine authorities, seven members of a group dedicated to the cause reasserted that the Scarborough Shoal has been part of China's territory since 1279 during the Yuan Dynasty. They also accused the Philippines of disrupting Chinese fishermen's operations in the area and of inciting anti-China demonstrations among Filipinos.

“From a historical and legal perspective, the Scarborough Shoal is doubtlessly part of China's territory,” the protesters said, before handing the letter to the Philippine consulate.

China and the Philippines have overlapping territory in the 150 square-kilometer reef that lies 126 nautical miles west of Subic Bay.

China has sent more than 30 ships to the area near the reef since the dispute erupted about a month ago when Philippine forces boarded eight Chinese fishing vessels and confiscated their catch.

Hong Kong and the Philippines had been on good terms until August 2010, when eight Hong Kong tourists were killed on a bus hijacked by a former Filipino police officer.

Hong Kong has since maintained a “black” alert for travel to the Philippines, warning local people not to go to that country.

Meanwhile, China News Service reported Friday that the Philippine side has resumed contact with China's embassy in Manila and has taken diplomatic initiatives to ease tensions with China over the disputed Scarborough Shoal.

A spokesman for China's Foreign Ministry said he welcomed Manila's proposals. However, Beijing will continue to closely monitor developments and watch Manila's moves, he said.

China's dubious and ridiculous claim that the Scarborough Shoal and the entire South China Sea (aka East Vietnam Sea, aka West Philippines Sea) is part of its territory runs contrary to what its own defense minister, Liang Guanglie said in the June 2011 Asian Security Summit in Singapore. He declared in no uncertain terms that "there has always been freedom of navigation in the South China Sea because NOBODY OWNS IT".

It is now self-evident that the latest events expose Beijing's imperialist ambitions beyond the Great Firewall and are intended as a sleight-of-hand to draw its propaganda-ridden population's attention away from growing cracks and differences in opinion within the communist political and military leadership.

From the preponderance of evidence cited by the Philippines... I believe Philippines has enough legal claim from the Scarborough. China must get away from Scarborough since the Philippines claimed cited heavy claims against China. China government must get away from disputed Scarborough for them to achieve the peacefulness and not to make this incidence proceeded to international settlement.

Nicholas Bequelin exposes the flaws of the Chinese system or regime because the laws are not being enforced. Yes, law does matter to keep the harmony within the society.

The facts that Chinese leaders do not practice or apply their own laws that they have written for their own country, what would give them the incentives to respect international treaties that they have signed?

Therefore, the international community should not be complacent about the Chinese claims of the whole South China Sea as their own territorial water because the sea carries the country’s name and allegedly Chinese may have discovered those islands in their voyage text books or maps from the ancient times.

Just wondering, what does this have to do with the ownership of the Scarborough Shoal? Do you only depend on how rich or poor the country is, when in fact they are fighting against territory? Haven't you heard of internet connection? This website can be browsed from any part of the world regardless if you are "acting like they're Chinese" or you are a Chinese. Mind you, there are people who are called broadminded that do not judge with what most people claim. I'm not really much into this territorial dispute between our countries but I think that this little disagreement turning into a large issue is somewhat intriguing...
I like China and I'd like to visit China at least a dozen times in my life...

Just look back into Filipino history and you will come to a conclusion that Filipino are conquered people. First came the Spanish (that's why you all have Spanish names) then the Japanese and finally the American. You guys are LOSERS (both militarily and economically).

Do you know the Philippine government is one of the BIGGEST LAND GRABBERS in the S. China Sea? Philippine has 7 islands, Malaysia has 7, Vietnam has 6, and China has 3. Check out this WIKI map for yourself. Most of the islands are well outside of Philippine's EEZ. So apparently distance or proximity doesn't matter as long as you are in control. Now I know why Malaysia and Vietnam stay quiet when Philippine ask for help.

Dear everyone, China is a big mess. Don't worry they will self-destruct without any outside interference. The common people are uneducated and the educated people are educated in a way that.....well makes them ignorant as to what is real. I feel sorry for them. The world is big and ugly. Monsters exist in the form of greedy oil grabbing companies. We can not change this. My biggest wish is to run out of oil. This may save the world. Every country has dangers. Now in China "western trash" are being persecuted by CCTV journalists resulting in the beatings of several Innocent people in Beijing. Soon the next cultural revolution will begin and I will go back to my country Canada. There will be many Chinese there looking for a better life but in fact it will not be better as they do not have the brain capacity to truly see the beautiful from the ugly. They are always asking me about the welfare in Canada imagining they won't have to work if they immigrate there. They seem to disbelieve me when I tell them everyone must work to live in Canada. So sorry that no school, teacher, parent, government leader sees fit to teach the young people of China the truth about the world. Old cultures that do not change will lose in the end. The writing is on the wall please read it. The island will lose all its fish, treasures, and beauty if not by the Chinese then by the Filipinos. In the end the Island loses.

See the map? The islands are perfectly nested between Vietnam, Philippines and Malaysia. Furthermore, Palawan of the Philippines is very close to the islands. Let's take a look at the OTHER image in the page that uses your image.

I am Filipina and I have seen how Chinese people live especially those in small cities. They are kind, so friendly and they help without expecting anything in return. Too sad that many people are talking bad things about them when they themselves never been here. People from big cities are different. What the Chinese gov't doing may be wrong, but the Filipino people don't need to make it worse. We Filipinos don't need to give more attention to this issue, we don't need it now. There are more important things that we need to worry about. China and the Philippines are both developing countries and I agree with "ejomlexus", make it THE FRIENDSHIP ISLAND... or lets just say, leave the island alone.

All over the nation yesterday, vibrant Philippine flags were raised in different places - Malolos Bulacan, Kawit Cavite, Rizal Park (where huge statues of two national heroes stand, Lapu-Lapu and Jose Rizal), etc. Such emblems were lifted up just about everywhere throughout the Philippine territories, except where they are needed the most: Mischief Reef and Scarborough Shoal. The first is just 80 nautical miles off the coast of Palawan; the second, only 120 nautical miles from Masinloc, Zambales. Both are well within the 200 nautical mile Exclusive Economic Zone of the Philippines. And both are over 500 nautical miles from the nearest Chinese coast.

This prayer is in protest over the Chinese government’s continuing intrusion and occupation of Mischief Reef and Scarborough Shoal (in gross violation of International Law), on the occasion of the 114th Anniversary of Philippine Independence.

I'm a Filipino, yes we r really not much, we admit that and we don't like wars and battle.....we want peace. However, we will protect our sovereignty as long as we uphold a law...........lets just fix this in International Court. Whatever will be the result we Filipinos will RESPECT that. It is true that we have been conquered by these countries-- but I don’t see how that is connected with the territorial dispute between us and China. We are not itching for fight, in fact we are democratically negotiating with China to end this territorial dispute. If you think you're having problems with your own country then mind your own business, smartas*.

Why not just give China the stupid shoal anyway? It's just a stupid godforsaken rock in the middle of the sea, for crying out loud! There are better things to fight over, and this is not one of them! The Philippine economy is suffering because of this stupid argument about a ROCK!

Anyway it's already a world fact that the Philippines will always lose in any given conflict (name one incident where this didn't happen). We are the world's nerd, that guy everyone can bully without repercussions.

China, you are not faultless either. Go pick on someone your own size, why are you bullying a country whose population is a tenth of yours? It's already known that the Philippines always loses in every conflict it's involved in. No need to rub it in.

Scarborough Shoal is an integral part of the Philippine territory. It is part of the Municipality of Masinloc, Province of Zambales. It is located 124 nautical miles west of Zambales and is within the 200 nautical-mile Exclusive Economic Zone (EEZ) and Philippine Continental Shelf.

Scarborough Shoal is a ring-shaped coral reef, which has several rocks encircling a lagoon. About five of these rocks are above water during high tide. Of these five rocks, some are about 3 meters high above water. The rest of the rocks and reefs are below water during high tide.

Obviously, therefore, the rocks of Scarborough shoal is also within the 200-NM EEZ and 200-NM continental shelf (CS) of the Philippines.

The matter that the rock features of Scarborough Shoal are not included or within the limits of the Treaty of Paris as alleged by China is therefore immaterial and of no consequence.

The baseline in the following areas over which the Philippines likewise exercises sovereignty and jurisdiction shall be determined as “Regime of Islands” under the Republic of the Philippines consistent with Article 121 of the United Nations Convention on the Law of the Sea (UNCLOS):

a) The Kalayaan Island Group as constituted under Presidential Decree No. 1596; and

b) Bajo de Masinloc, also known as Scarborough Shoal.


Chinese assertion based on historical claims must be substantiated by a clear historic title. It should be noted that under public international law, historical claims are not historical titles. A claim by itself, including historical claim, could not be a basis for acquiring a territory.

Under international law, fishing rights is not a mode of acquiring sovereignty (or even sovereign rights) over an area.

1.) Someone mentioned that Filipinos lost every war they ever engaged in. That is not entirely true. When the Spaniards first reached the Philippines (Mactan), Lapu-Lapu and his men defeated the Spaniards as soon as they stepped foot on the beaches. When Magellan and his troops first arrived, they had three ships. They left Mactan with only one (Victoria).

A few years later, the Spaniards returned but this time, decided to use a different strategy: religion. Filipinos, being religious as they are, were easily moved by the story of Christ and the promise that they would no longer have to live fighting other tribes. The Filipinos back then were very barbaric (and some tribes still are), but they were softened by religion. The first Christian converts of the country were royals-- Muslim Royals to be exact. After the conversion... BAM! Hello Spain!

(Spain also offered gold and convinced said Muslim Royals that the Christian God could poop out tonnes and tonnes of gold.)

The reason why Filipinos are very difficult to unite is because they come from different ethncities: Indonesian, Malay, Arab and Chinese. There is NO SUCH THING AS A PURE FILIPINO. Before Spain invaded the country, the Malaysians and Arabs in the South were already fighting with the Indonesian migrants in the North. Spain's arrival made everyone realize that they were no longer Malaysians, Arabs, Chinese or Indonesians and they had to be united as a new country to survive.

From the very beginning, you could say the Filipinos were ethnically confused.

2.) Next, people are saying that China owns the Spratlys Islands based on a 1200's map. Let's be clear here, folks: 1200's China is not equal to People's Republic of China. 1200's China was Kublai Khan's Dynasty. 1200's China was the Yuan Dynasty, the third piece of the now-broken up Mongolian Empire. It was a dynasty built and ruled by an ethnically Mongolian ruler named Kublai Khan who lost the rest of Asia due to uprisings. Fortunately for him, he managed to keep the site were mainland China is today.

What PRC is doing is reclaiming its old dynasties, but it no longer has a right to do that when the new countries have already announced their sovereignty. Also, the "map" you speak of is owned by the Mongolian Empire. Where is the Mongolian Empire today? It was crushed in the late 1300's.

In the 1960's, Mao drafted a plan to expand to the West. This move was bashed by many countries but he managed to expand to Kashmir, Pakistan. I wouldn't be surprised if he drafted a plan to expand to the East too. That's what PRC is doing today.

Saying China owns Huangyan because of an old map is like saying Mongolia owns China, Russia, Pakistan, Persia (now Iran) and India based on a map made by the his grandfather, Genghis Khan! I'm secretly waiting for that time when China invades Iran because the Mongolian Empire ruled the Persians at one point. Let's see what happens when you piss off a nuclear-armed country. I dare China to use that "map-alibi" on Ahmedinajad.

Hey, Spain has a map of the entire Philippines, too, back when Filipinos were predominantly Muslims but they are not claiming sovereignty of the archipelago today.

1. China is a signatory of UNCLOS as well as Philippines. As such, historical claims are nullified when they have agreed to sign.
2. Scarborough Shoal is an uninhabitable piece of land, therefore it is considered as part of the archipelagic state of the Philippines which is within its EEZ.
3. China violated international laws when it poached on those waters, destroying coral reefs in the process.
4. More importantly.... China cannot just ignore UNCLOS just because it is disadvantageous to them. They should have not signed it on the first place. Just because they found out that there is possible oil reserves, they do not want to follow UNCLOS. Now, who is greedy?
