HTC to continue legal fight against IPCom

HTC filed a lawsuit with the U.S. District Court for the District of Columbia in 2008 to challenge a patent asserted by IPCom and the lower court judge invalidated the patent in 2010, according to the Taiwanese company.

The patent, which was coded U.S. Patent No. 6,879,830, involved technology which linked a mobile phone to a base station to allow the mobile phone to move from one coverage to another.

However, the U.S. Court of Appeals for the Federal Circuit reversed Monday the district court's decision to invalidate the patent asserted by IPCom and sent back the case to the lower judge.

According to the appeals court, the lower court judge could consider additional arguments on the validity of the patent since the district court misconstrued the claims, which covered only a partial apparatus.

HTC said the legal battle was not over and it would continue to insist in the district court on its claims that the patent asserted by IPCom was invalid.

The two companies have sued each other in the U.S., U.K. and Germany for patent infringement.
